Er feiert die Gesetzgebung als “Meilenstein bei der Neugestaltung des digitalen Raums”. Doch für Smart Contracts könnte es einen herben Einschnitt bedeuten, wegen eines umstrittenen Artikels 30. Er gefährdet ihre Dezentralität.
Der darin enthaltene Paragraf ist so formuliert, dass der derzeitige Einsatz von Smart Contracts erheblich eingeschränkt werden müsste. Die Kommission hat noch keinen rechtlichen Entwurf zum Data Act veröffentlicht. Deshalb bleibt abzuwarten, ob die Gesetzgeber auf den Wunsch zahlreicher Krypto-Branchenvertreter reagiert haben.
