Dr. Annette Wagemann: Die MiCA zielt darauf ab, einen europaweit einheitlichen Rechtsrahmen für Kryptowerte zu schaffen und Wettbewerbsnachteile zu beseitigen, die darauf zurückzuführen waren, dass für bestimmte Teilmärkte keine oder nur geringe Regelungen bestanden. Insoweit liegt ein Schwerpunkt der MiCA auch in einer Rechtsangleichung der Verbraucherschutzbestimmungen und stärkt insoweit auch die Rechte der Verbraucher.
Wo sehen Sie noch Nachbesserungsbedarf bei der MiCA?
Die MiCA ist zwar recht voluminös, aber dennoch kein umfassendes Regelwerk für Kryptowerte. So sind beispielsweise Kryptowerte, die als Finanzinstrumente einzustufen sind, nicht von den Regelungen der MiCA erfasst.
